A bill for an ordinance amending the alcohol beverages and retail marijuana chapter of the Denver Revised Municipal Code to create a licensing scheme in which promotional associations may operate common areas for the consumption of alcohol within approved entertainment districts in the City and County of Denver.
Amends the Denver Revised Municipal Code (DRMC) to add a new Section in Chapter 6, Article II for the licensing and regulation of alcohol common consumption areas, the certification and regulation of promotional associations, and the creation and regulation of entertainment districts within the City. The Committee approved filing this item at its meeting on 10-23-19.

This ordinance creates a five-year pilot program for a new license type in Denver for the consumption of alcohol by persons over the age of 21 in designated common consumption areas. The ordinance creates this local-only license in compliance with state law and the Colorado Liquor Code that allows for the licensure of common consumption areas within designated entertainment districts, so long as the common consumption area license is held by a promotional association that has been certified by the local licensing authority and the entertainment districts are created by City Council. The ordinance contains definitions of commonly used terms, details the application requirements for certification of a promotional association and licensure of a common consumption area, describes the requirements for a public hearing, identifies the procedures for transfers of ownership and various types of license modifications, describes causes for denial and unlawful acts, and sets fees. The ordinance requires the Director of Excise and Licenses to undergo rulemaking before the ordinance is effective.
