The State legislature passed and the Governor signed SB 22-009 Recertification and theft of catalytic converters on June 7, 2022. This new law outlines a number of changes, including: requiring CO DPHE to establish procedures for aftermarket catalytic converters; on and after October 31, 2022, it is unlawful to install, sell, offer for sale, or advertise any used, recycled, or salvaged catalytic converter unless the catalytic converter is an aftermarket catalytic converter that has been certified for installation and sale; amends the definition of "commodity metal" to include rhodium, palladium, or platinum-clad components of a catalytic converter; adds catalytic converters to the definition of "major component motor vehicle part"; and requires the auto parts recycler to consult the national motor vehicle title information system to determine if the item is stolen.

 

However, we believe this will have a limited impact on the theft of these items because there is not an identifying serial number on catalytic converters, making a check against a national or any registry irrelevant. There is also no requirement to report to law enforcement the purchase of used catalytic converters by auto parts recyclers similar to legislation in other states. This proposed ordinance will outline the appropriate identification required when selling a used catalytic converter and requires the auto parts recyclers to notify DPD within one day of the purchase - both requirements mirror the current pawn brokers act.
