The Original 1966 Easement for Right-of-Way Pipeline was between Army Corp of Engineers (Army) and Wyco Pipeline Company. In 2004, the Army conveyed to Kaneb PipeLine Operating Partnership, LP. The City, successor in interests to the Army related to fee title in the easement area and Magellan Pipeline (“Magellan”), successor in interest to Kaneb agree to relocate certain facilities and to modify the legal description to reflect new alignment. Magellan has agreed to relocate certain facilities within a portion of the Easement Area and the City and Magellan now wish to modify the legal description of the Easement Area to reflect the new alignment. Magellan will relinquish the rights in the easement area they move from and the City will grant them rights to the area Magellan will move their facilities to.
