Submits to a vote of the qualified and registered electors of the City and County of Denver at the general municipal election on April 4, 2023 a ballot measure authorizing the release of the conservation easement on the property known as the Park Hill Golf Course and allowing commercial and residential development, including affordable housing, and public regional park, trail and open space. The Committee approved filing this item at its meeting on 12-13-2022.

The privately owned former Park Hill Golf Course is currently covered by a city-held conservation easement that requires the property to be used, maintained and operated as a regulation-length 18-hole daily fee golf course. Substantial community engagement and visioning efforts have resulted in a plan for alternative future uses on the site. Section 39-193 of the Denver Revised Municipal Code (an initiated ordinance approved by voters in the November 2021 election) requires voter approval for extinguishment of a conservation easement and the construction of commercial or residential building on land protected by a conservation easement. Following the adoption of a new area plan for the site, and consideration of related measures including zoning and a development agreement that provide legally binding framework for parks and open space, affordable housing, community-serving retail and other purposes, this ballot measure allows voters to have the final say in lifting the easement and allowing these other uses or leaving the easement in place and continuing limitation to golf-related uses.
