A bill for an ordinance designating certain properties as being required for public use and authorizing use and acquisition thereof by negotiation or through condemnation proceedings of fee simple, easement and other interests, including any rights and interests related or appurtenant to properties designated as needed for the installment of Phase 1 of the 48th Avenue Greenway (Outfall) project on 48th Avenue from Emerson Street continuing west to Washington Street. This includes easement interests, access rights, improvements, buildings, fixtures, licenses, and permits as part of the Project.
Grants the authority to acquire through negotiated purchase or condemnation of all or any portion of any property interest as needed in support of the 48th Avenue Greenway Outfall Project, including easement interests, access rights, improvements, buildings, fixtures, licenses, permits and other appurtenances, located at 48th Avenue from Emerson Street to Washington Street in Council District 9. The Committee approved filing this item at its meeting on 4-11-2023.

The 48th Avenue Outfall, when complete, will provide better drainage in the Globeville neighborhood with the potential to create a community connection to the South Platte River, expand access to green space, and further the community’s goal of a more walkable neighborhood. The overall project alignment starts at Lincoln Street and 48th Avenue, continues along 48th Avenue to a new stormwater outfall into the South Platte River.
This Project will require negotiated purchase or condemnation of all or any portion of any property as needed and is located in District 9. This includes easement interests, access rights, and improvements. This ordinance also grants the right to negotiate and execute all agreements and to process all necessary payments.
Phase 1 of the 48th Avenue Greenway project requires 9 full acquisitions (7 commercial and 2 residential), 1 partial acquisition (commercial) 1 drainage easement (commercial) and 3 temporary easements (commercial).
