A bill for an ordinance approving a proposed Intergovernmental Agreement between the City and County of Denver and the City of Commerce City for design, construction, and funding related to Tower Road Widening and the Tower Road/Pena Boulevard Interchange.
Approves an intergovernmental agreement with Commerce City for $6.5 million and for four years to extend and build the Tower Road Widening construction project from the southern boundary of Commerce City into the City to the intersection of the Tower Road and Peña Boulevard Interchange (201737072). The last regularly scheduled Council meeting within the 30-day review period is on 11-13-17. The Committee approved filing this bill by consent on 10-17-17.

Type and Scope of services to be performed:
Purpose: This IGA for the Tower Road Widening from the southern boundary of Commerce City through Denver property to the southernmost edge including the area of the southern signalized intersection of the Tower Road and Pena Boulevard Interchange. Denver will be responsible for one hundred percent (100%) of the actual costs of construction to complete the Tower Road Widening Improvements within Denver.
Cost/value: Not to exceed maximum of $6,000,000.00 for the construction including contingency with an additional 45% of the construction management costs and 2.5% interest over 4 years per the IGA. $1,500,000 to be paid by the City upon execution of this agreement and another $1,246,000 before January 31, 2018 and $1,246,000 in 2019 and 2020 with the final 4th year being (by January 31, 2021) the balance due in accordance with the Final Cost Allocation per IGA estimated at a total cost of approximately $6.5 million.

Benefit: This contract entails the partnering by Denver PW, DEN, & Commerce City to coordinate and extend the Tower Road widening within Denver from the Tower & Pena Interchange to the County Line with Commerce City’s Tower Road widening project currently nearing completion from the County Line (approximately 80th Avenue) to 104th Avenue.
