Type and Scope of services to be performed:

The project developer and construction contractor have already started work under a DPR Temporary Construction Access Permit (TCAP) and have occupied the Park since Q2 of 2022 and intend to occupy until December of 2023 to complete façade improvements adjacent to the park. They have requested and received permission from DPR to erect protective fencing, remove and store existing light poles, protect park facilities and provide erosion control during construction.  At the completion of their work they are obligated to restore the park to its prior condition, replace the light poles and construct the new sidewalks and patio as compensation for impacts to the park. The proposed improvements are shown in Exhibits A, B, C and D that are attached to the agreement.
