A bill for an ordinance amending Article XI (Refund Payments to Elderly or Disabled Persons) of Chapter 53 of the Denver Revised Municipal Code (Taxation and Miscellaneous Revenue).
Amends Article XI of Chapter 53 of the Denver Revised Municipal Code (DRMC) relating to the Refund Payments to Elderly or Disabled Persons program to expand eligibility including to low-income homeowning families with children, citywide. The Committee approved filing this item at its meeting on 12-19-18.

Members of City Council, staff from the Mayor’s Office, and staff from administrative agencies (DHS, OED, Finance) have worked collaboratively to develop the expansion of the current tax refund program for persons with disabilities and/or older adults. The proposed changes will expand eligibility to low-income homeowning families with children, to help address the impact of increased property tax on low-income homeowners in Denver and help stabilize these groups of homeowners (and some renters) who are eligible for the program. The program will continue to serve eligible persons with disabilities and/or older adults who are renters, and for this group the program will not substantially change. The income eligibility will increase slightly for persons with disabilities and/or older adults who are homeowners, and will now tie that group’s income eligibility to Area Median Income. Eligible homeowning families with children will also have income eligibility tied to Area Median Income, at a slightly higher level than the persons with disabilities and/or older adults who are homeowners. The program will be administered as a first come, first serve benefit, and will be subject to available appropriation (as opposed to an entitlement program). Assuming passage of the ordinance change, there will be a formal rule making process.
