Within Denver Economic Development & Opportunity, the Division of Small Business Opportunity (DSBO) is governed by the DRMC Chapter 28 Articles III (Construction), V (Goods & Services), and VII (Small Business Enterprise). In this context, these sections are referred to collectively as “the DSBO Ordinance” or simply “the Ordinance.” The DSBO Ordinance was last amended in December 2019 to establish a sunset date of May 1, 2020.

 

DSBO’s authority is established by Executive Order as well as the DRMC, and its Ordinance is typically re-authorized at five-year intervals. The DSBO Ordinance enables the city to undertake specific activities to prevent discrimination and counter its effects on, as well as create opportunities to support the success of, certified business enterprises.

 

Since 2017, DSBO has worked with multiple stakeholder groups and a third-party consultant to make recommendations to the Ordinance with the goal of improving DSBO and the services provided for small, minority and women-owned businesses. DSBO is committed to addressing these recommendations by making changes to the Ordinance, its Rules and Regulations, and internal policy and procedures. In the spirit of continuous improvement, DSBO continually engages the community and business owners to prioritize recommendations.

 

New in this latest round of reauthorization work, DSBO enjoys a much stronger collaboration with other city agencies involved in the procurement for, awards of, and management of large contracts. A substantial citywide effort has been directed to, and will continue to continuously improve upon, systems to ensure the prompt payment of both prime and subcontractor invoices. The Ordinance has also been reorganized to read in a more linear and logical fashion, improving the ability for a community person or layperson to access this critical legislation that authorizes city programs to create, sustain, and measure compliance on activities that support a more level playing field for small minority- and women-owned firms on public contracts. Finally, the city’s growing commitment to creating and sustaining a more equitable marketplace for all residents and their businesses is also strongly reflected.
