A bill for an ordinance making a rescission from and an appropriation in the Capital Improvements and Capital Maintenance Fund.
Rescinds $1,495,000 of capital improvement funds and appropriates $1,995,000 of capital improvement funds, including $500,000 of contingency, to address ADA improvements at City facilities identified as part of the current DOJ settlement. The Committee approved filing this item at its meeting on 11-2-21.

During 2020, the City entered into supplemental negotiations with the U.S. Department of Justice under Project Civic Access (PCA) to improve accessibility for individuals with disabilities. Negotiations were occurring during the development of the 2021 budget; and in an effort to be proactive, the City appropriated budget for ADA improvements based on the draft list of contemplated facilities.
In January 2021, a four-year supplemental agreement with the Department of Justice (DOJ) was executed to address ADA improvements in 18 additional facilities not included in the original agreement. The final list of facilities included City administrative and human services facilities, safety buildings, and performing arts venues. It did not include parks and recreation or library facilities.
This ordinance request is to rescind and re-appropriate capital improvement funds, including a use of $500,000 of contingency, to immediately address those facilities included under the four-year mandate:

Appropriate: 33069 5000000 GK070 ADA Improvements $1,995,000
