Last year, Council Bill 21-0216 established a licensed marijuana delivery program with a focus on opportunities for social equity applicants. The program included an initial three-year period during which social equity marijuana transporter businesses would have the exclusive ability to conduct marijuana deliveries on behalf of licensed marijuana stores. Under the program, stores would be required to contract with social equity licensees to conduct delivery until July 1, 2024.

 

During the first year of exclusivity for social equity applicants, the Department has seen very few stores engage with social equity transporter businesses to conduct deliveries, making it difficult for social equity transporter businesses to succeed. The Department has also received feedback that the fees for delivery permits and transporter licenses appear to be a significant barrier to new and existing businesses.

 

This ordinance is narrowly crafted to address these challenges by replacing the three-year exclusivity period with permanent exclusivity for social equity marijuana transporter businesses to conduct deliveries on behalf of licensed stores. This ordinance also reduces the licensing fees for marijuana delivery permits and transporter licenses.
