A bill for an ordinance amending Ordinance 20220426, Series 2022, to extend the deadline by which an applicant must obtain approval of a building permit in order to comply with the requirements of Articles V or VI, Chapter 27 of the DRMC, as applicable, as it existed prior to July 1, 2022.
Amends Chapter 27 of the Denver Revised Municipal Code to extend the date by which applicable legacy projects must obtain the required building permit from 12-31-2022 to 6-16-2023, allowing Community Planning and Development the additional time required to review all applicable legacy plans submitted prior to the passage of Expanding Housing Affordability. The Committee approved filing this item at its meeting on 11-1-2022.

In April of this year, CPD committed to monitor and report out on site development plan projects submitted in advance of the Expanding Housing Affordability initiative effective July 1, 2022. We are continuing to do that work and have found that projects that require a building permit that are not subject to a site development plan are being impacted by our backlogs. These projects are primarily permits for single-family/duplex residential projects that were submitted, accepted for review and paid their plan review fees prior to June 30, 2022, but due to the amount of time it is taking our staff to complete reviews, will not meet the December 31, 2022, date contained in the ordinance for building permit issuance.
Because of this, CPD requests an ordinance to amend Ordinance 20220426 to change the approved by date in Section 4(b)(5) from December 31, 2022, to June 16, 2023. This applies only to projects that require a building permit but not a site development plan.
