A resolution approving and providing for the execution of a proposed Grant Agreement between the City and County of Denver and the United States of America Environmental Protection Agency concerning the “Brownfields Assessment Grant FY-22” program and the funding therefor.
Approves a grant agreement with the United States Environmental Protection Agency for $500,000 and through 6-30-2025 to implement the Boulevard Brownfield Initiative (BBI), which includes conducting environmental site assessments and cleanup planning activities with applicable partners along a 6.5-mile stretch of the Federal Boulevard corridor in council districts 2, 3 and 7 (ESEQD-202265007). The last regularly scheduled Council meeting within the 30-day review period is on 12-5-2022. The Committee approved filing this item at its meeting on 11-2-2022.

Type and Scope of services to be performed:
Dept. of Public Health & Environment is requesting approval of the EPA cooperative agreement so the City can receive grant funding for brownfields assessment activities. Brownfield is a term used to describe redevelopment of contaminated property or potentially contaminated property; generally low-level risk properties not covered under a regulatory environmental cleanup program e.g. Superfund. Typical brownfield sites include historical gas stations and dry cleaners, legacy commercial and industrial sites, and buildings with asbestos containing building materials.
The City and County of Denver, Dept. of Public Health & Environment - in partnership with the City of Sheridan (Sheridan) in neighboring Arapahoe County, and the Urban Land Conservancy (ULC) (a 501c3) - will implement the Federal Boulevard Brownfield Assessment Grant, branded as the Boulevard Brownfield Initiative (BBI), to conduct environmental site assessment (ESA) and cleanup planning activities within 6.5-mile Federal Boulevard corridor that runs north-south from 6th Avenue in Denver through Sheridan’s southern border, ending at South Clay Street. The east and west borders of the corridor will extend approximately two blocks in either direction.
The cooperative agreement funding will be used to cover the costs of activities at selected brownfields sites on behalf of non-profit and for-profit developers, and property owners seeking to redevelop these sites, especially affordable housing projects. 10 phase I ESAs (environmental records review assessment) and 10 phase II ESAs (onsite environmental sampling assessment) are anticipated to be completed under the grant. Apart of the grant activities is a significant community engagement component which will include community meetings with Spanish and Vietnamese interpretation, a brownfields 101 training, community member participation in site selection, a grant website, and a written community involvement plan.
The cooperative agreement is posted dated to July 1, 2022, to cover EPA approved pre-award costs. These pre-award costs are travel related expenses to the EPA National Brownfields Conference in Oklahoma City, August 16-19, which was attended by 4 staff from Denver and Sheridan. Typically, EPA would have completed cooperative agreements prior to the conference but EPA was delayed in announcing awards this year.
