State law requires a public hearing be conducted prior to City Council approving a service plan for a new metropolitan district, or an amendment to a service plan for an existing district, with no less than 20 days’ notice prior to the hearing.  The public hearing for City Council’s consideration of the respective First Amendments to Service Plan for each of the respective Denargo Market Metropolitan District Nos. 1-3 (“Districts”) is scheduled to be March 28, 2023.  The Districts’ original purpose was to manage, implement, and coordinate the financing, acquisition, construction, completion, operation, and maintenance of public improvements and services for the Denargo Market project.  In 2021 an amended General Development Plan (“GDP”) and a rezoning was approved for the Denargo Market project.  These changes authorized greater development density and greater public infrastructure requirements.  The First Amendments to Service Plan seek to align the Districts’ description and operations with the new GDP and zoning.

 

EXECUTIVE SUMMARY

 

The purpose of the resolution is to set a public hearing to approve the respective First Amendments to Service Plan for each of the respective Denargo Market Metropolitan District Nos. 1-3. 

 

The Districts’ original purpose was to manage, implement, and coordinate the financing, acquisition, construction, completion, operation, and maintenance of public improvements and services for the Denargo Market project.  In 2021 an amended General Development Plan (“GDP”) and a rezoning was approved for the Denargo Market project.  These changes authorized greater development density and greater public infrastructure requirements.  The First Amendments to Service Plan seek to align the Districts’ description and operations with the new GDP and zoning.

 

State law requires notice of a public hearing on the First Amendments to Service Plans be provided at least 20 days prior to a public hearing/ The public hearing is currently scheduled to be at City Council on March 28, 2023. A presentation in Finance and Governance Committee is anticipated to occur on March 7, 2023.

 

The ordinance requesting to approve each of the respective First Amendments to Service Plan will follow this resolution and staff will be asking for the resolution to pass out of committee on consent since a presentation is expected to be conducted as part of the ordinance approving the First Amendments to Service Plan.
