A bill for an ordinance amending the Denver Revised Municipal Code in connection with the execution of the revised Executive Order 28 creating Denver Economic Development and Opportunity, the rescission of Executive Order 91, and the execution of Executive Order No. 145 creating the Department of Housing Stability.
Amends the Denver Revised Municipal Code (DRMC) to update references to the Department of Housing Stability as appropriate, and to make policy changes, including utilizing performance deeds of trust and liens to address compliance with City affordability requirements and restructuring the City’s Housing Advisory Committee to support the entire housing continuum. The Committee approved filing this item at its meeting on 2-26-20.

Amends the Denver Revised Municipal Code to update references to point to the Department of Housing Stability as appropriate. Amends the DMRC to make some policy changes to Chapter 27, including an update to the city’s Housing Advisory Committee to support the entire housing continuum.
Policy amendments include:
• Ch 27, Article III
• Waiving the city’s right of first refusal on affordable properties when a perpetual covenant (99+ years) is recorded in a form satisfactory to city
• Ch 27, Article IV
• Changing the admin cap in the IHO to a percentage (5%) or $250K, whichever is greater
• Utilizing covenants (existing), performance deed of trusts (proposed addition), and liens (proposed addition) to protect compliance with the city’s affordability requirements
• Ch 27, Article V
• Clarify the use of resources from the property tax fund for supportive housing
• Reimagining the Housing Advisory Committee
• Ch 27, Article VI
• Clean up references to incentive calculations based on gross floor area
